FIANCE VISA APPLICATIONS (Prospective Spouse Visa)

Documents Checklist

Use this checklist to ensure your application for migration is complete. You should include all this information with your application at the time of lodgement. These documents are required to make a decision on your application.

Processing Times
The period for processing an application is usually between 3-6 months, but may vary on a case by case basis. Processing times may be considerably longer if incomplete documentation is submitted.

Certified Copies
The Visa section recognises certification of documents by a Notary Public, Commissioner for Oaths or an Advocate/Solicitor. Also, authorised persons in Australia include – Justice of the Peace, solicitor, bank manager and any person before whom a statutory declaration can be made.

All documents not in English must be translated - please refer to the attached instructions.

 APPLICANT

 2 recent passport-sized photographs of yourself (please attach to your migration application)

Please provide certified copies of original version and translation of :

 Birth certificate

 Biodata page of your current passport (no need for translation)

 Letter (on letterhead) from an authorised marriage celebrant showing date and venue of intended marriage and including confirmation that a Notice of Intention to Marry (NOIM) has been lodged.

 Divorce documents including court order or Death certificate of previous spouse (if previously married)

 Defence Force discharge documents (if applicable)

 For Non-Malaysians : Statement providing date of arrival in Malaysia, purpose of stay and Malaysian visa (if available)

Health and Character

Please note that medical forms are given to you at time of lodgement or sent to you by mail.

 Form 26 (medical examination – please refer to the Panel Doctor list )

 Form 160 (radiological report on chest x-ray)

 Original & a certified copy of Malaysian Certificate of Good Conduct – for all applicants aged 17 years and above who have resided in Malaysia for at least 12 months within the last 10 years prior to lodgement of the migration application. For Malaysian Penal check procedures, please refer to the guidelines attached.

 Original & a certified copy of Overseas Police certificate - for all applicants aged 17 years and above who have resided in any one country for at least 12 months within the last 10 years prior to lodgement of the migration application. Please refer to http://www.immi.gov.au/allforms/character-requirements/index.htm for the relevant procedures.

Note: Penal clearances/police certificates are valid for 12 months from the date of issue. If your migration application has not been finalised and the penal clearance has expired, you are required to submit a fresh penal clearance if you have stayed in the relevant country for a total of 2 months or more after the date of issue of the previous penal clearance for that country.

Your Relationship

 Attach evidence that you have personally met and have a genuine and continuing relationship with your fiance.

For examples of evidence that can be supplied to support the existence of a genuine and continuing relationship, see  Evidence of relationship-Partner Migration.  Please note that this is a guideline only. You should provide a statement outlining the history of your relationship.

APPLICANT’S PARTNER (SPONSOR)

 2 recent passport-sized photographs of your sponsor (please attach to your migration application)

 Evidence of Australian citizenship or permanent residency or status as an eligible New Zealand citizen (eg. Australian passport biodata page, certificate of Australian citizenship, Resident return visa label).

A sponsor who is a permanent resident but who is NOT USUALLY RESIDENT in Australia, must demonstrate his/her intention to settle in Australia in the near future.

Evidence of documents to be provided may include:

 Freight/shipment arrangements to move personal belongings back to Australia

 Accommodation arrangements in Australia

 Flight arrangement (one-way) for the near future to return to Australia

 Resignation and acceptance from Malaysian employment and/or acceptance of a job offer in Australia

 Registration of enrolment for school-age going children

Please provide certified copies of original version and translation of :

 Divorce documents or death certificate of previous spouse (if previously married)

Please provide evidence that Sponsor is able to meet sponsorship obligations (you are not required to provide all of the below, but a substantial amount of evidence):

 Statement from the sponsor on how he/she intends to meet sponsorship obligations in Australia i.e. provide adequate financial assistance and accommodation in Australia for the applicant.

 Evidence required may include (please provide certified copies of original documents) : Australian income, overseas tax assessment notices, bank statement, rental agreement/ownership of property, a letter from your employer confirming length of employment and annual salary including current payslips, business documents or a letter from your accountant if you are self-employed or self-funded from other sources.

APPLICANT’S DEPENDENT CHILDREN/FAMILY MEMBERS (if applicable)

 2 recent passport-sized photographs of all dependent children/family members included in the migration application (please attach to your migration application)

Please provide certified copies of original version and translation of:

 Birth Certificate

 Adoption papers (if applicable)

 Death certificate (if child is deceased)

 Biodata page of child’s/dependent family member’s current passport (if child/dependent family

 member is migrating)

If the child is under 18 years : Consent letter or a statutory declaration from each person who has a legal responsibility to the child stating that they have no objection to the child’s migration and the biodata and signature pages of the passport of the consenting person. Note: This requirement is not necessary if it is the child of both the applicant and the sponsor.

Health and Character

Dependent family members aged 18 years or over

 Form 47A (Details of child or other dependent family member aged 18 years or over).
 Documentary evidence of dependency on main applicant.

NOTE: Dependent children NOT included in the migration application will still need to undergo a health check (mandatory) and character checks (if aged 17 years and above).
